These Terms and Conditions explain the rules for using our website, placing wholesale order requests through our website, and buying from us.

By using our website or placing an order request, you agree to these Terms. Please read them before submitting an order request.

1. About us

This website is operated by Forms of Discovery Ltda., doing business as Forms of Discovery.

In these Terms, “we,” “us,” and “our” mean Forms of Discovery. “You” means the person using our website, buying from us, or contacting us about wholesale.

2. Using our website

You may use our website for wholesale enquiries, order requests, and general browsing.

You agree not to:

  • use the website for anything unlawful;

  • interfere with the website or its security;

  • copy, scrape, or collect information from the website without permission;

  • upload or send viruses, harmful code, spam, or similar materials;

  • use our content, photos, product descriptions, or branding without written permission.

We may restrict access to our website if we reasonably believe the website is being misused or used in a way that affects its security, operation, or other customers.

3. Product information

We do our best to describe our products clearly and accurately.

Please note:

  • Product colours may look slightly different depending on your screen.

  • Measurements are approximate and may vary slightly.

  • Small differences in fabric, texture, colour, or construction may occur, especially with handmade, natural, vintage, or artisan-made items.

  • Product availability may change without notice.

If we find a clear mistake in a product description, price, or availability, we may correct it. If the mistake affects an order request you have already submitted, we will contact you and explain the available options.

4. Prices and payment

Our website is currently available to wholesale buyers only. All prices shown on our website are wholesale prices, unless clearly stated otherwise.

We show local currencies where available. The currency shown may depend on your location and the options available through our payment providers.

The currencies we currently accept are BRL, GBP, EUR, HKD, JPY, KRW, and USD.

If your local currency is not available, or if you choose to pay in a currency that is not your local currency, your bank, card issuer, payment provider, or payment platform may charge extra fees. These may include currency conversion fees, international transaction fees, or other charges. These fees are not charged by us and are your responsibility.

Wholesale payment is handled outside the website through invoices, email, bank transfer, credit or debit card, or another payment method agreed in writing.

Credit and debit card payments are completed through PayPal and have a 4% card processing fee.

Bank transfers are completed through Wise and have no processing fee from us. Your bank or Wise may still charge fees depending on your country, currency, or account.

Discounts may be provided separately to approved wholesale buyers and may be subject to minimum order quantities, separate payment terms, or other conditions.

We may change prices at any time, but price changes will not affect orders that we have already accepted in writing.

5. Wholesale orders

We sell wholesale to approved stockists.

Wholesale order requests are usually placed through our website. They may also be arranged by email, invoice, line sheet, order form, or another written agreement between you and us.

How it works

  1. Apply to become a stockist.
     Fill out the form at https://formsofdiscovery.com/pages/wholesale. We will review your application within 1 business day. Once approved, you will be able to log in with your application email and submit an order request.

  2. Browse the store and submit your order request.
     Build your cart, review your selection, and submit your order request online. You will receive an email confirmation with a summary of your request.

  3. We review your request and email your invoice.
     Your invoice will include the total order amount, estimated delivery timeline, and payment terms. Please allow 1–2 business days for us to prepare it.

  4. Complete payment or request changes.
     In-stock purchases ship after full payment. Pre-order and made-to-order purchases begin or reserve production with a 40% deposit. Detailed payment information will be provided with your invoice by email. Once payment is confirmed, we will queue your order and send a confirmation email.

  5. Your Forms of Discovery order ships.
     Shipping is currently free for approved stockists. Orders ship DAP — Delivered at Place. This means we cover the shipping cost, while you are responsible for any import duties, taxes, customs fees, or local charges on arrival.

Wholesale prices, payment terms, minimum order quantities, delivery terms, cancellations, returns, exchanges, and other conditions may be negotiated and will always be confirmed in writing.

If there is any conflict between these Terms and the written terms agreed for a wholesale order, the written wholesale terms will apply to that wholesale order.

Wholesale buyers are responsible for checking whether the products they buy from us are suitable for resale in their market. This may include checking any local laws, labelling rules, import rules, tax rules, or other requirements that apply to their business.

In some exceptional cases, we may not be able to accept or complete an order. For example, this may happen if:

  • payment is not approved;

  • the shipping address is incomplete or incorrect;

  • we reasonably believe the order may be fraudulent, unauthorised, or placed for unapproved resale;

  • we cannot ship to your location;

  • the order cannot be completed for reasons outside our reasonable control.

If we are unable to complete an order for reasons caused by us, we will refund any amount paid for the cancelled order, including any deposit.

If an order is cancelled by you, or if the final balance is not paid within the required time, any non-refundable deposit will not be refunded.

6. Minimum orders

All opening orders must meet both of the following minimums:

  • a minimum total order value of R$3,500 BRL, or the equivalent in your local currency; and

  • a minimum quantity of 5 units per style.

The current equivalent minimum order values are:

  • £500 GBP

  • €600 EUR

  • ¥110,000 JPY

  • ₩1,000,000 KRW

  • $5,500 HKD

  • $750 USD

Currency equivalents may change over time due to exchange rates. The minimum order value that applies to your order will be confirmed in writing before payment.

7. Purchase types and lead times

We offer three purchase types: in-stock, pre-order, and made-to-order.

In-stock purchases

In-stock purchases are items that are available and ready to ship.

In-stock purchases ship after full payment has been received.

Pre-order purchases

Pre-order purchases are items that are already in production and have an estimated ready-to-ship date.

The estimated ready-to-ship date will be shown on the product page or confirmed in writing.

Pre-order purchases allow approved stockists to reserve selected styles, colours, sizes, and quantities before the items are ready to ship.

Unless we agree otherwise in writing, pre-order purchases are paid in two parts:

  • a 40% deposit when the order is confirmed; and

  • the remaining 60% balance when the item is ready to ship.

The 60% balance must be paid within 14 days of our payment request sent by email.

The 40% deposit is non-refundable because it confirms the order and reserves stock for you. If we are unable to complete your order, we will refund the deposit.

Made-to-order purchases

Made-to-order purchases are items produced after your order is placed.

All made-to-order purchases have a 90-day production lead time, unless we agree otherwise in writing.

Because production begins specifically for your order, made-to-order purchases are paid in two parts:

  • a 40% deposit when the order is confirmed; and

  • the remaining 60% balance when the item is ready to ship.

The 60% balance must be paid within 14 days of our payment request sent by email.

The 40% deposit is non-refundable because it helps cover production costs. If we are unable to complete your order, we will refund the deposit.

If the final 60% balance for a pre-order or made-to-order purchase is not paid within 14 days of our payment request, we may treat the order as cancelled. In that case, the 40% deposit will not be refunded.

8. Shipping and delivery

Shipping method, shipping costs, delivery timing, insurance, and delivery terms are explained in our Shipping Policy and may also be confirmed separately in writing.

At the time these Terms were last updated, shipping is free for approved stockists worldwide.

Free shipping does not include import duties, taxes, customs fees, or other local charges that may apply in your country.

Orders ship DAP — Delivered at Place, unless we agree otherwise in writing. This means we cover the shipping cost, while you are responsible for any import duties, taxes, customs fees, or local charges on arrival.

Buyers are responsible for checking any import, resale, tax, customs, registration, labelling, or compliance requirements that apply in their own market, and for paying any associated taxes and fees, unless we agree otherwise in writing.

Customs rules vary by country. Delays, extra charges, or rejected deliveries may occur if an order is held by customs or does not meet local import rules.

Please make sure your shipping address is complete and correct. Along with your invoice, we will ask you to confirm your shipping address before we send any items.

We are not responsible for delays or failed delivery caused by incorrect shipping details.

Delivery times are estimates only. Delays can happen because of customs, carrier issues, weather, holidays, high order volume, or events outside our control.

Once your order ships, we will send tracking information by email.

9. Returns, exchanges, and refunds

Our Returns Policy explains when and how items can be returned or exchanged. Please read the Returns Policy before placing an order.

Returns and exchanges

In general, returned items must be unused, unworn, unwashed, undamaged, and returned with original tags and packaging.

Some items may not be returnable, such as final sale items, custom items, or items clearly marked as non-returnable.

We offer one free return on your first order for your peace of mind. The cost of shipping for any future return is your responsibility, unless we agree otherwise in writing or unless the return is due to our mistake.

Refunds

In-stock purchases are fully refundable if returned in line with our Returns Policy.

For pre-order purchases and made-to-order purchases, the 40% deposit is non-refundable unless we are unable to complete your order.

The remaining 60% balance is refundable if the order is cancelled before shipping or if the item is returned in line with our Returns Policy.

If the final 60% balance is not paid within 14 days of our payment request, we may treat the order as cancelled. In that case, the 40% deposit will not be refunded.

Refunds are made to the original payment method where possible. If this is not possible, we will agree another refund method with you in writing.

10. Faulty or incorrect items

Please contact us as soon as possible if you receive a faulty or incorrect item.

Email us at contact@formsofdiscovery.com with:

  • your order number or invoice number;

  • a short description of the issue;

  • clear photos or videos.

We will review the issue and explain the next steps.

If the item is confirmed to be faulty or incorrect, we may offer a repair, replacement, refund, credit, or another appropriate solution, depending on the situation, the purchase type, any written wholesale terms, and applicable law.

Normal wear and tear, damage caused by misuse, incorrect washing, accidents, or failure to follow care instructions is not considered a fault.

11. Care instructions

Please follow the care instructions provided with each product.

We are not responsible for damage caused by incorrect washing, drying, ironing, storage, alteration, or use.

Natural fabrics, dyed fabrics, and delicate materials may change over time with wear, washing, sunlight, and use. This is part of the life of the item and is not always considered a fault.

12. Promotions and discount codes

Discount codes and promotions may have their own rules.

They may be limited by date, product, location, customer, or order value.

We may change, pause, or end a promotion at any time.

Discount codes cannot usually be applied after an order has been placed.

Unless we clearly agree otherwise in writing, website promotions, retail discount codes, and retail shipping offers do not apply to wholesale orders.

13. Gift cards and store credit

Gift cards and store credit may only be used on our website, unless we say otherwise.

They cannot be exchanged for cash, except where required by law.

Lost or stolen gift cards may not be replaced.

Gift cards may expire if allowed by law and clearly stated when issued.

Gift cards and store credit cannot usually be used for wholesale invoices, unless we agree otherwise in writing.

14. Website content

All content on our website belongs to us or is used with permission. This includes text, photos, graphics, logos, product names, designs, videos, and other materials.

You may not copy, reproduce, publish, sell, or use our website content for commercial purposes without our written permission.

You may share links to our website in a fair and honest way, as long as it does not suggest that we sponsor, approve, or are connected to you unless we have agreed to that in writing.

Wholesale buyers may use product images, descriptions, or brand materials only if we give written permission. We may set guidelines for how our brand and product information can be used.

15. Third-party links

Our website may include links to other websites.

We are not responsible for the content, policies, or practices of third-party websites. We recommend reviewing their terms and policies before using them.

16. Privacy

Our Privacy Policy explains what personal information we collect, how we use it, who we share it with, and what choices or rights you may have.

Please read our Privacy Policy before using our website, placing an order request, or contacting us about wholesale.

17. Limits on our responsibility

We are responsible for losses that are a direct and foreseeable result of our breach of these Terms.

We are not responsible for:

  • losses caused by events outside our reasonable control;

  • business losses, lost profit, lost sales, or lost opportunity;

  • delays caused by shipping carriers, customs, or incorrect delivery details;

  • damage caused by misuse, normal wear and tear, or failure to follow care instructions;

  • website interruptions, technical issues, or errors outside our reasonable control;

  • a wholesale buyer’s resale, marketing, import, labelling, tax, or legal obligations in their own market.

Nothing in these Terms limits any rights you have under laws that cannot be excluded.

18. Events outside our control

Sometimes things happen that we cannot reasonably control.

This may include natural disasters, strikes, transport delays, customs delays, power outages, internet issues, supplier delays, government actions, or other unexpected events.

If this happens, we will do our best to keep you informed, but we are not responsible for delays caused by these events.

19. Changes to these Terms

We may update these Terms and Conditions from time to time.

The latest version will always be posted on this page with the “Last updated” date.

By continuing to use our website after changes are posted, you agree to the updated Terms.

20. If part of these Terms cannot apply

If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will still apply.

21. Governing law

These Terms are governed by the laws of São Paulo, Brazil, unless your local law requires otherwise.

Any disputes will be handled by the courts or legal process of São Paulo, Brazil, unless applicable law gives you the right to bring a claim somewhere else.
